Introduction

Welcome to DB Music Studio (“we,” “our,” “us,” or the “Studio”). These Terms and Conditions (“Terms”) govern your access to and use of our website, as well as the music instruction services, facilities, events, and programs offered by DB Music Studio.

By accessing our website, enrolling in lessons, or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services or access our website.

1. Services

1.1 Music Instruction

DB Music Studio provides music lessons, coaching, and related educational services. Specific offerings, schedules, and instructors are subject to change. We reserve the right to assign or reassign instructors at our discretion.

1.2 Studio Facilities

Access to our studio facilities is limited to enrolled students during their scheduled lesson times, pre-arranged practice sessions, and public events. Use of studio equipment and instruments is subject to instructor approval and supervision.

1.3 Online Services

Any online lessons, digital content, or virtual services provided by DB Music Studio are subject to these Terms as well as any additional terms specific to digital platforms.

2. Registration and Enrollment

2.1 Enrollment Process

Students must complete the registration process and submit all required forms before beginning lessons. For minor students (under 18 years of age), a parent or legal guardian must complete the registration process.

2.2 Assessment

We reserve the right to conduct initial assessments to determine appropriate placement and instruction levels. This assessment may result in recommendations for specific instructors, class types, or lesson frequency.

2.3 Accurate Information

You agree to provide accurate, current, and complete information during the registration process and to update such information promptly if any changes occur.

3. Payment and Fees

3.1 Fee Structure

Tuition and fees for lessons and services are set according to our current rate schedule, which may be updated periodically. Current rates will be provided during enrollment and are available upon request.

3.2 Payment Methods

We accept payments via credit card, electronic bank transfer, check, or cash. Payment methods may vary depending on the type of service.

3.3 Payment Schedule

Tuition is due according to the payment schedule selected during enrollment:

  • Monthly payments are due on the 1st of each month
  • Quarterly payments are due on the first lesson of each quarter
  • Annual payments are due at the beginning of the enrollment period

3.4 Late Payments

A late fee of $25 will be assessed for payments received more than 5 days after the due date. Lessons may be suspended if payment is more than 15 days past due.

3.5 Returned Payments

A $35 fee will be charged for any returned checks or failed electronic payments.

4. Scheduling and Attendance

4.1 Lesson Schedule

Lessons will be scheduled at mutually agreed times. The regular lesson schedule will continue until formally changed or terminated according to these Terms.

4.2 Student Cancellations

Students must provide at least 24 hours’ notice to cancel or reschedule a lesson. Lessons canceled with less than 24 hours’ notice will be forfeited and charged at the full lesson rate.

4.3 Make-up Lessons

Make-up lessons for properly notified cancellations will be scheduled based on instructor availability within 30 days of the missed lesson. We cannot guarantee that make-up lessons will be available with your regular instructor or at your regular time slot.

4.4 Instructor Cancellations

If an instructor must cancel a lesson, we will provide as much advance notice as possible and offer either a make-up lesson or a credit to your account.

4.5 Tardiness

If a student arrives late for a lesson, the lesson will still end at the scheduled time. If an instructor is late, the full lesson time will be provided or appropriate credit will be issued.

5. Term and Termination

5.1 Enrollment Period

Unless otherwise specified, enrollment is ongoing until formally terminated by either party according to these Terms.

5.2 Student Termination

Students wishing to discontinue lessons must provide written notice at least 30 days before the intended final lesson. Any pre-paid tuition beyond the termination date will be refunded, less applicable fees.

5.3 Studio Termination

DB Music Studio reserves the right to terminate lessons at any time for reasons including but not limited to: repeated no-shows, disruptive behavior, failure to adhere to studio policies, or non-payment of fees. In such cases, any unused pre-paid tuition will be refunded on a pro-rated basis.

6. Studio Policies

6.1 Conduct

Students and visitors are expected to conduct themselves in a respectful manner while on studio premises or participating in studio-sponsored events. DB Music Studio reserves the right to remove anyone who engages in disruptive or inappropriate behavior.

6.2 Parental Supervision

Parents or guardians of minor students may observe lessons with instructor approval. Children under 12 years of age must be supervised by an adult when not in their lesson.

6.3 Property Damage

Students (or their parents/guardians) will be responsible for any damage to studio property or equipment caused by negligence or misuse.

6.4 Personal Belongings

DB Music Studio is not responsible for lost, stolen, or damaged personal belongings brought to the studio or events.

7. Intellectual Property

7.1 Studio Materials

All educational materials, compositions, arrangements, and recordings provided by DB Music Studio remain the intellectual property of the Studio or their respective copyright holders. These materials may not be reproduced, distributed, or used for commercial purposes without express written permission.

7.2 Student Performances

DB Music Studio may record student performances for archival and promotional purposes. By participating in studio recitals or events, you grant the Studio permission to use such recordings for promotional purposes, unless you specifically opt out in writing.

7.3 Website Content

All content on our website, including text, graphics, logos, images, and software, is the property of DB Music Studio or its content suppliers and is protected by copyright laws.

8. Media Release

By enrolling in lessons or participating in studio events, you grant DB Music Studio permission to use photographs, audio recordings, and video recordings of students for educational and promotional purposes, including but not limited to the studio website, social media, brochures, and advertisements, unless you specifically opt out in writing.

9. Liability and Waivers

9.1 Assumption of Risk

Participation in music lessons and related activities involves inherent risks. You agree to assume all risks associated with participation in studio activities.

9.2 Limitation of Liability

To the maximum extent permitted by law, DB Music Studio, its owners, employees, and contractors shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of or inability to use our services.

9.3 Indemnification

You agree to indemnify and hold harmless DB Music Studio, its owners, employees, and contractors from any claims, losses, damages, liabilities, including legal fees, arising out of your violation of these Terms or your use of our services.

10. Health and Safety

10.1 Medical Conditions

Students (or parents/guardians) must disclose any relevant medical conditions that could affect participation in music lessons or studio activities.

10.2 Emergency Procedures

In case of emergency, Studio staff will attempt to contact parents/guardians of minor students and may seek appropriate medical attention as deemed necessary.

10.3 Facility Safety

All students and visitors must adhere to posted safety guidelines and emergency procedures while on Studio premises.

11. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy on our website for information on how we collect, use, and share your information.

12. Changes to Terms

DB Music Studio reserves the right to modify these Terms at any time. We will provide notice of significant changes through our website or direct communication. Your continued use of our services after such modifications constitutes your acceptance of the revised Terms.
